Terms of Service
Last updated: October 22, 2026 · Effective: October 22, 2026
These Terms of Service ("Terms") are an agreement between you and Sorry Not Public LLC ("Sorry Not Public," "we," "us," or "our"). They cover Hey Cursor, our personal AI assistant, on iPhone and Android, on the web at sayheycursor.com, and on your Mac as Hey Cursor for Mac, together with our websites and anything else that links to these Terms (the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Services.
IMPORTANT: Section 12 contains an arbitration agreement and a class action waiver. Unless you opt out within 30 days as described there, disputes between you and us will be resolved by binding individual arbitration, and you give up the right to a jury trial and to take part in a class or representative action.
1. Who May Use the Services
You must be at least 18 and able to form a binding contract.
2. Your Account
You sign in with a one-time code sent to your mobile number or email. Give us accurate information and keep your phone and email secure. You are responsible for activity on your account.
Choose a username you have the right to use, and don't impersonate anyone.
Accounts are personal and may not be shared or transferred. Tell us right away about any unauthorized use.
Access to some features may be offered gradually or by invitation.
You can delete your account in the app at any time. We may suspend or end accounts that break these Terms, commit fraud, or put others at risk.
3. Using Hey Cursor
What you send Hey Cursor (messages, voice, files, photos) is "Input." What it returns (answers, drafts, files, and other results) is "Output." Things your Cursors do for you, in a connected app, on a website, or on your Mac, are "Actions."
What it does. Hey Cursor chats and talks with you, remembers what you tell it, keeps your goals, tasks, and reminders, and, through Cursors you create, does tasks for you in apps you connect and, with Hey Cursor for Mac, on your Mac.
You stay in control. Your Cursors ask before Actions that send, delete, share, or spend, unless you choose otherwise. You are responsible for the Actions you approve, so review them first.
AI can be wrong. Output may be inaccurate or incomplete and is not legal, financial, tax, medical, or other professional advice. Check anything important before you rely on it.
Your Mac. Mac features require Hey Cursor for Mac and the macOS permissions you grant. A Cursor may work on your own files and apps; keep backups and only authorize actions you understand and have the right to perform.
Teams. What you say in a team's chat, ask its Cursors, and share with a team is visible to its members. Team owners and admins manage who is on the team.
Shared Cursors. A Cursor you share in Browse Cursors is reviewed before others can see it. Don't include private information in it. A Cursor someone adds becomes their own copy.
Connected apps. You may connect third-party apps. You authorize Hey Cursor to access and act in them, through our app-connection provider, within the permissions you grant and the Actions you approve. You can disconnect any app at any time.
Risks. An AI assistant can misunderstand a request, act in a way you didn't intend, or be misled by content in a website, email, or document. Use the permission settings, review Actions, and connect only accounts you are comfortable with Hey Cursor using.
4. Plans and Payments
Hey Cursor has a free plan and paid plans (Pro and Max). Each plan includes a number of messages and agent messages each month, shown on our pricing page and in the app before you pay. On Pro and Max, talk is unlimited for your own everyday use; we may give quicker answers after an unusually heavy day so Hey Cursor stays available for everyone.
Allowances reset on your billing date and do not roll over. They have no cash value and cannot be sold or transferred.
Paid plans are billed monthly by Stripe and renew until you cancel. You can cancel at any time; your plan stays active until the end of the month you paid for. Except where the law requires, payments are non-refundable. Nothing is charged automatically beyond your plan.
On iPhone, plans are purchased on our website.
We may change prices or allowances with at least 30 days' notice before your next billing period.
Prices are in U.S. dollars, and you are responsible for applicable taxes.
Invite discounts and referral earnings follow our Invite & Earn Terms at sayheycursor.com/referral-terms.
5. Acceptable Use
Our Privacy Policy explains how we handle your information. When using the Services, you may not:
Use the Services unlawfully or to harm, harass, or deceive anyone
Give false information, impersonate others, or create fake accounts
Use Hey Cursor, its Cursors, or connected apps to spam, scrape, attack, gain unauthorized access, or break the terms of other services
Share content that is illegal, infringing, hateful, harassing, or misleading, or distribute malware
Abuse plans, allowances, payments, invitations, or referrals
Reverse engineer, overload, or interfere with the Services, or bypass their limits or access controls
Share your account or sign-in codes
We may remove content or restrict accounts that break these rules.
6. Rights We Grant You
Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable, revocable right to use the Services for your own purposes.
7. Ownership and Your Content
We and our licensors own the Services, including the software, design, and brands. These Terms give you no rights in them except as stated in Section 6.
You keep ownership of your Input, of what you create and share, and, as between you and us, of your Output. Only add material you own or have permission to use. You give us a non-exclusive, worldwide, royalty-free license to host, display, process, and transmit it as needed to run the Services for you.
8. Third-Party Services
Connected apps, websites, and other third-party services are provided by their own companies under their own terms. We are not responsible for them, their content, or their availability.
9. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, and we do not promise that Output is accurate, that the Services will be uninterrupted or error-free, or that your data will be preserved. Keep your own backups of important work.
10. Limitation of Liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, or consequential damages, including from reliance on Output, Actions you approve, third-party services, loss of data, or unauthorized access to your account. Our total liability for any claim is limited to the greater of $100 or the amounts you paid us in the 12 months before the claim.
11. Indemnification
To the extent the law allows, you will defend and hold us harmless from claims by third parties arising from your content, your use of the Services, or your breach of these Terms.
12. Arbitration and Class Action Waiver
Please read this section carefully. It affects your legal rights.
Informal resolution first. Before starting arbitration, you and we agree to try to resolve a dispute informally. Send a written notice describing the dispute and the relief sought (through sayheycursor.com/contact, or from us to your account's email or phone). If it isn't resolved within 60 days, either party may start arbitration.
Binding individual arbitration. Any dispute arising from or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitrator decides all issues, including whether a dispute must be arbitrated, except as stated below. Arbitration may be held by video or phone, or in Hillsborough County, Florida.
Exceptions. Either party may bring an individual claim in small claims court, and either party may seek court relief to stop infringement or misuse of intellectual property.
Class action waiver. You and we may bring claims only on an individual basis, not as a plaintiff or class member in any class, collective, or representative proceeding, and the arbitrator may not combine claims of more than one person. If this waiver is found unenforceable for a claim, that claim will proceed in court and not in arbitration.
Jury trial waiver. You and we give up the right to a jury trial.
Opting out. You can opt out of this arbitration agreement within 30 days of first accepting these Terms by sending us a message through sayheycursor.com/contact with the subject "Arbitration Opt-Out," including your name and the phone number or email on your account. Opting out does not affect the rest of these Terms.
Governing law and venue. These Terms are governed by the laws of the State of Florida and the Federal Arbitration Act, without regard to conflict-of-law rules. Any dispute not subject to arbitration will be resolved in the state or federal courts located in Hillsborough County, Florida.
13. Additional Provisions
Changes. We may update these Terms. We will tell you about material changes in the app or by email before they take effect. Using the Services after changes take effect means you accept them.
Availability. Features may change, be paused, or be removed, and updates to the apps may change how they work.
Survival. Sections on content, payments, disclaimers, limits of liability, indemnification, and arbitration survive the end of your account.
Entire agreement and severability. These Terms and the Privacy Policy are the entire agreement between you and us about the Services. If any part is unenforceable, the rest stays in effect.
No waiver or assignment. Our not enforcing a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
